1. Agreement and service
These Terms of Use apply to Connektly, its associated Meta app and WhatsApp Cloud API integration, and shivammadaan.com, operated by Shivam Madaan, India ("we", "us", or "our"). By using these services, you agree to these terms. If you do not agree, stop using the services.
Connektly enables businesses to connect authorized WhatsApp Business accounts and manage business messaging through Meta's WhatsApp Cloud API. Features available to you depend on the account, configuration, and permissions granted. Any separate written service agreement we enter into with you takes precedence over conflicting provisions here for that service.
Connektly is independently operated. Use of Meta APIs or WhatsApp names does not imply endorsement, certification, or a partnership with Meta or WhatsApp.
2. Eligibility, accounts, and authorization
To create or administer a business platform account, you must be at least 18 or the age of legal majority where you live, and have authority to act for the business you connect. Provide accurate account information and connect only accounts, phone numbers, and business assets you own or are authorized to manage.
You are responsible for your authorized users, safeguarding credentials and access tokens, and activity carried out through your account. Notify us promptly at official@shivammadaan.com if you suspect unauthorized access. Do not share passwords or one-time codes in support messages.
3. WhatsApp messaging and consent
You must follow applicable law, the WhatsApp Business Messaging Policy, WhatsApp Business Terms, and Meta Platform Terms, as applicable to your integration.
- Obtain the recipient permissions and opt-in required for your communications, maintain appropriate evidence, and accurately identify your business.
- Respect opt-outs and requests to stop messaging. Do not send spam or contact people through purchased, scraped, or otherwise unauthorized contact lists.
- Use approved message templates where required and follow the customer service window and other messaging restrictions set by WhatsApp.
- Provide a way for customers to obtain appropriate support, including a clear human support or escalation path where automation is used.
You are responsible for the messages you send, their recipients, and the notices, consent, and other permissions your business requires.
4. Acceptable use
You must not use the services to break the law, infringe intellectual property or privacy rights, impersonate another person or business, distribute malware, commit fraud, harass people, or facilitate prohibited goods or services. Do not request unnecessary sensitive identifiers in messages.
Do not attempt unauthorized access, bypass security or platform limits, interfere with the service, misuse another customer's data, or use the integration beyond the permissions granted. We may restrict activities that threaten users, the service, or compliance with applicable platform policies.
5. Privacy, business data, and intellectual property
Our Privacy Policy describes our data practices. Our Data Deletion instructions explain how to request removal of information. Where you provide customer data, you are responsible for having the right to provide it, giving appropriate notices, obtaining required permissions, and issuing lawful processing instructions. A separate data processing agreement may be required for your use.
You retain rights to your business content and messages. You grant us only the permission needed to host, process, transmit, and display that content to provide the authorized service, subject to applicable law and the Privacy Policy. This does not transfer ownership of your content to us.
The website's branding, design, software, music, artwork, and other materials belong to their respective owners. Access does not grant a right to reproduce, resell, redistribute, or commercially exploit them without permission or an applicable license. Any digital product license is limited to the rights stated with the product or separately agreed in writing.
6. Service charges and website purchases
Any Connektly fees, billing terms, and cancellation or refund conditions must be disclosed at purchase or agreed separately before they apply. Meta, WhatsApp, payment providers, or other third parties may impose their own charges under their terms. You are responsible for charges you authorize.
For website purchases, the product, price, currency, and applicable terms are those shown at checkout. Payments are handled by Razorpay. A test payment does not purchase or deliver a real product. Where delivery is described as manual, contact us with the verified payment ID to arrange delivery.
For billing errors, non-delivery, cancellations, or refund requests, email official@shivammadaan.com with the relevant order or payment ID. Any applicable purchase-specific terms and mandatory consumer rights continue to apply.
7. Meta, WhatsApp, and other third-party services
Third-party services operate under their own terms and privacy policies. We do not control their availability, pricing, account verification, template approval, messaging limits, or enforcement decisions. You must maintain any required third-party accounts and authorizations.
We do not guarantee Meta app approval, WhatsApp Business verification, message delivery, template approval, a particular messaging limit, or uninterrupted third-party access. Changes to an API or platform policy may require changes to Connektly.
8. Suspension, termination, and deletion
You may stop using the service, revoke the connected integration, and contact us to close your account. See the Data Deletion page to request deletion of stored information; disconnecting an integration alone does not remove all existing data.
We may suspend or end access where reasonably necessary to address a breach of these terms, a security threat, unlawful use, non-payment of agreed charges, or a requirement from Meta, another provider, or law. Where practicable and legally permitted, we will explain the reason and any available remedy. Immediate restrictions may be necessary to protect the service or others.
Ending access does not remove accrued payment obligations or terms intended to survive termination. Information is handled in accordance with our Privacy Policy and applicable law.
9. Availability, warranties, and responsibility
We aim to provide a reliable service but may need to carry out maintenance, fix errors, or change features. Unless a separate agreement states otherwise, the services are provided on an "as available" basis, without a promise of uninterrupted or error-free operation, to the extent permitted by law.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses, lost profits, or losses caused by your misuse, unauthorized third-party activity, or third-party outages outside our reasonable control. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or any mandatory consumer or data protection rights.
You remain responsible for your business communications, instructions, and compliance obligations. Any separately agreed service level or liability terms apply to the service covered by that agreement.
10. Governing law, updates, and contact
These terms are governed by the laws of India, subject to any mandatory protections and rights available under the laws that apply to you. Contact us first so we can try to resolve a concern. Nothing here restricts your right to approach a competent court or regulator.
We may update these terms as the service changes. The revised terms and update date will be published on this page, with additional notice where required. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
